Acceptance of Terms By purchasing, accessing, or using the educational materials provided by Shares in Motion Australia Pty Ltd, you acknowledge that you have read, understood, and agree to be bound by the following Terms and Conditions.

1. General Educational Disclaimer All content, training, intellectual property, and materials provided by Shares in Motion are strictly for educational and factual informational purposes only. The information provided does not constitute General or Personal Financial Product Advice as defined by the Corporations Act 2001 (Cth).

2. Instructor Qualifications & Licensing Status The creator and instructor of this content, Adam Graham, is a formerly qualified financial planner. However, Adam Graham is no longer licensed, does not currently hold an Australian Financial Services Licence (AFSL), and does not act as an authorised representative of any licensee. None of the educational material provided takes into account your personal objectives, financial situation, or needs.

3. Payment, Access, and Refund Policy Access to Shares in Motion requires a one-off payment, which unlocks proprietary intellectual property hidden behind secure passwords.

• Change of Mind: Due to the immediate delivery and digital nature of this intellectual property, Shares in Motion does not offer refunds for a "change of mind" once the course portal has been accessed.

• Consumer Guarantees: Nothing in these Terms excludes, restricts, or modifies any rights or statutory guarantees you may have under the Australian Consumer Law (ACL), including if a digital product is fundamentally faulty or materially misdescribed.

4. Third-Party Software (Incredible Charts) As part of your enrollment, Shares in Motion will pay for your first 12 months of access to Incredible Charts.

• After the initial 12-month period expires, you are solely responsible for paying any ongoing subscription costs if you wish to continue using their software.

• Incredible Charts is a third-party platform. Shares in Motion accepts no liability for their service uptime, data accuracy, software glitches, or changes to their terms of service.

5. Assumption of Risk and Indemnity Trading financial markets involves a high degree of risk and is not suitable for all persons. Any strategies, setups, or market analysis taught in this course reflect the training of a professional trader but are not instructions or recommendations for you to execute real trades in the live market.

• If you decide to act upon the education provided and trade with live capital, you do so entirely at your own risk.

• Indemnity: To the maximum extent permitted by Queensland and Australian Federal law, you agree to indemnify, release, and hold harmless Shares in Motion Australia Pty Ltd, Adam Graham, and any affiliated entities from any direct, indirect, or consequential financial losses, damages, or legal liabilities you may incur as a result of acting upon the educational materials provided.

6. Intellectual Property, Non-Disclosure (NDA), and Confidentiality All materials, training modules, trading strategies, custom code, and documentation provided inside the course portal remain the exclusive intellectual property of Shares in Motion Australia Pty Ltd.

• Blanket NDA: By purchasing and accessing this content, you are entering into a strict, blanket Non-Disclosure Agreement (NDA) and confidentiality binding.

• No Sharing or Distribution: You are explicitly prohibited from sharing, copying, recording, reproducing, selling, or distributing any proprietary information, course materials, or your personal login credentials with any third party.

• Enforcement: The intellectual property provided is for your individual use only. Shares in Motion reserves the right to immediately terminate your access without refund if we detect shared logins or unauthorized distribution of our proprietary content, and we reserve the right to pursue damages for breach of confidentiality and copyright infringement under Australian law.
